Damage Control: Citizens of London

The citizens’ group alleges that Jerry’s actions, conducted under InBev’s instruction, resulted in substantial damage to their property and risk to their health. They argue that this constitutes both public and private nuisance, and that InBev is liable for the cost of restoration. A student activist organization from Western University, the Green Regulators for Environment, Education, and Compassion (GREEC) has further claimed that InBev has essentially committed a human rights abuse and is liable for punitive damages. The group has some NGO backing, but InBev is aware that their resources are strained.

Advise InBev on how to handle the situation. What strength do the group’s claims have before the court? For what is InBev liable and are punitive damages likely?
